Terms of service.
These terms govern your use of Obsidian Security's website, the client and staff portals we operate, and the security services we provide. By using any of them you agree to these terms. If you have a signed master services agreement with us, that contract governs and these terms fill in anything it doesn't address.
What we provide
Obsidian Security provides licensed guard services across British Columbia — static guards, mobile patrol, firewatch, alarm response, loss prevention, event security, executive protection, and construction-site security.
Our services are supported by an operations platform we built and run in-house: scheduling, dispatch, GPS-verified patrols, compliance tracking, and a client portal. Portal access is provided to our clients and staff as part of the services — the software itself is not offered for sale or licence.
Acceptable use
You agree not to:
- Use our website or portals to violate any law or regulation.
- Attempt to access data that isn't yours — another client's sites, reports, or invoices — or to disrupt the integrity, security, or performance of our systems.
- Reverse-engineer our software except as permitted by applicable law.
- Use our systems to send unsolicited communications or to scrape data at scale.
- Misrepresent your identity or your right to act on behalf of a client or site.
Portal accounts
Client and staff portal accounts are issued by us as part of a services engagement. You are responsible for the security of credentials issued to you, the accuracy of information you submit through the portal, and the conduct of users you ask us to authorize for your organization.
You will keep contact information current so we can reach you about service-affecting incidents, invoices, and material policy changes.
Fees
Security-services fees, billing schedules, and payment terms are governed by the master services agreement or written quote signed with each client — not by this page. Invoices are issued in CAD unless your agreement says otherwise. Portal access is included with the services at no separate charge.
Intellectual property
We retain all rights to our software, the Obsidian Security brand, and any documentation we make available. You retain all rights to the operational records that concern your sites — reports, daily activity records, incident files. We use them only to deliver the services you engaged us for.
Portal availability
We aim for high availability of the client and staff portals but the portals are a supporting tool, not the service itself — guard coverage, dispatch, and incident response do not depend on portal uptime. Master services agreements may include specific service levels.
We may schedule maintenance windows. Unscheduled service-affecting incidents will be communicated to affected clients by email.
Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim related to the website or portals is limited to the fees you paid us for services in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental damages including lost profits, lost data, or business interruption. Liability arising from the security services themselves is addressed in each client's master services agreement and our insurance coverage.
Nothing in these terms limits liability that cannot be limited by law, including liability for fraud, willful misconduct, or personal injury caused by negligence.
Termination
Portal access ends when the related services engagement ends. We may suspend or terminate access for material breach of these terms with reasonable notice — except in cases of abuse, fraud, or imminent harm, where suspension may be immediate.
Governing law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any dispute will be resolved in the courts of British Columbia, sitting in Vancouver.
Obsidian Security's registered office is located at 701 West Georgia Street, Suite 1500, Vancouver, British Columbia, V7Y 1C6, Canada.
Changes to these terms
We may update these terms. Material changes will be announced via email to active customers and via a banner on this page for 30 days before they take effect. Continued use after the effective date constitutes acceptance.
